Stockholm: Challenges to investment treaty arbitration awards in the Svea Court of Appeal
In a lunch discussion Joel Dahlquist Cullborg and Eric De Brabandere will talk about cases, in which parties have asked the Court to set aside treaty-based arbitral awards.
Joel Dahlquist Cullborg has recently defended a doctoral dissertation in international law at Uppsala University. The topic of his research is the use of commercial arbitration rules in investment treaty disputes.
In a lunch discussion, Joel and Professor Eric De Brabandere will talk about challenges to investment treaty arbitration awards in the Svea Court of Appeal. There has been a number of such cases, in which parties have asked the Court to set aside treaty-based arbitral awards. They will explore questions such as: How has the court approached these cases? Is there, or should there be, a difference between awards based on investment treaties and awards based on contracts?

Joel Dahlquist Cullborg holds a doctorate in international law and is a lecturer at Uppsala University. His research is on the intersection between commercial arbitration and treaty disputes and he teaches international arbitration, private and public international law and international investment law. In addition to his academic activities, Joel works as administrative secretary to arbitral tribunals and is a regular contributor to Investment Arbitration Reporter. Previously, Joel has clerked in a Stockholm court and interned with UNCITRAL Working Group II. He holds a Master of Laws from Lund University, has studied at Bucerius Law School in Hamburg and been a visiting researcher at Georgetown University Law Center and the Lauterpacht Centre for International Law. Joel is also the co-host of podcast The Arbitration Station.
Eric De Brabandere is Professor of International Dispute Settlement Law and Director of the Grotius Centre for International Legal Studies / International Law Department at Leiden University's Law School (the Netherlands). He is also Attorney-at-Law at the Brussels Bar (partner in De Meulemeester & De Brabandere - DMDB Law) practicing in international (investment) law and arbitration. He is Editor-in-Chief of the Leiden Journal of International Law, a member of the Board of Editors of the Journal of World Investment & Trade, the Revue belge de droit international (Belgian Review of International Law), and the Martinus Nijhoff Investment Law Book Series. He has published more than 80 articles, book chapters, and several books as editor or author in international investment law and arbitration and general international law, including Investment Treaty Arbitration as Public International Law (CUP, 2014).
