Swedish Arbitration Portal: the Svea Court of Appeal dismissed challenge to arbitral award

In a decision recently published on the Swedish Arbitration Portal, the Svea Court of Appeal dismissed a party’s challenge to the arbitral award, finding that there were not justifiable doubts as to the arbitrator’s impartiality and independence and the tribunal had not exceeded its mandate.

The party challenged the award, claiming that there were justifiable doubts as to the arbitrator’s impartiality and independence and that the arbitrator had exceeded his mandate. The Court found that nothing in the tribunal’s conduct constituted an excess of mandate. Additionally, the circumstances relied upon to argue that the arbitrator should have been disqualified were not sufficient to determine that there were justifiable doubts as to the arbitrator’s impartiality. The Court dismissed the challenge in its entirety.
