New on Swedish Arbitration Portal: Svea Court of Appeal dismissed challenge to arbitral award
In a decision recently published on the Swedish Arbitration Portal, the Svea Court of Appeal dismissed a party’s challenge to the arbitral award, finding that the tribunal had not exceeded its mandate and did not breach the principle of equal treatment of the parties.
The party challenged the award, claiming that the tribunal had breached the principle of equal treatment of the parties and had made a number of procedural errors that affected the outcome of the case. The party further claimed that it had been deprived of the opportunity to argue its case. The Court of Appeal dismissed the challenge in its entirety. The Court found that nothing in the tribunal’s conduct in the handling of the evidence or in the hearings constituted an excess of mandate or breached the principle of equal treatment.
