The SCC in Frankfurt
The Frankfurt Investment Arbitration Moot 2018 (FIAM) was preceded by a conference co-organized and sponsored by the SCC, law firm McDermott Will & Emery Rechtsanwälte Steuerberater LLP (MWE) and Goethe University. The conference took place on 12 March 2018 and was dedicated to salient issues regarding costs in investment arbitration.
The first panel, moderated by Arne Fuchs, partner McDermott Will & Emery, presented the audience with live examples of costs in investment arbitration, including procedures for proving costs, as well as their structure, calculation and allocation. Among the speakers were SCC Board member Bart Legum; Boris Kasolowski, partner Freshfields Bruckhaus Derringer and Natalia Petrik, SCC Legal Counsel.
The second panel was moderated by Daniel Lander (Senior Associate Lindahl) and dealt with third-party funding in investment arbitration. Among the debated issues were liability of third party funders and adverse costs awards, the effect of third party funders on orders for security for costs and best practices for arbitrators and third party funders. Sabine Konrad, partner McDermott Will & Emery; Frederik Andersson, partner Mannheimer Swartling and Dmitri Evseev, partner Arnold & Porter, shared their expertise and answered questions from the audience.
The SCC is a reoccurring sponsor to the conferences in connection with the Moot. The conference was addressed to the teams competing at the Frankfurt Investment Arbitration Moot 2018 as well as investment arbitration professionals.
