SCC practice note: Challenges to arbitrators 2013-2015
A recently published SCC Practice Note reviews decisions on challenges to arbitrators made by the SCC Board during 2013-2015.
The note, authored by SCC legal counsel Anja Havedal Ipp and SCC Intern Elena Burova, also discusses the standard for arbitrator impartiality in SCC arbitrations and explains the procedure for challenges to arbitrators. During the period examined, 28 challenges to arbitrators were filed – a very low number considering that almost 600 arbitral proceedings were initiated at the SCC during these three years. Of the 28 challenges, 9 were dismissed by the SCC Board, 4 were sustained, and 14 were resolved without a Board decision.
