Amicable and early settlement of energy disputes discussed at Kazenergy Forum
Last week, around 1,500 delegates attended the Kazenergy Eurasian Forum in Astana. One of them was SCC Secretary General Annette Magnusson, who spoke in a round table focusing on resolution of investment disputes within the energy sector.
On the 30 September, Kazenergy and the Energy Charter Secretariat jointly hosted a round table dedicated to the topic “Resolution of investment disputes”.During the two hour session, different stakeholders involved in energy dispute resolution discussed the great importance of alternative resolution mechanisms, and shared opinions and experience about settlement mechanisms.
One issue often lifted among the delegates was the importance of dialogue and mediation at an early stage of the dispute, both in order to prevent the issue turning into a legal dispute, but also for maintaining good long term relations. How to effectively implement these strategies is however seen as a challenge, together with the need to raise awareness among the stakeholders involved.
To address some of these issues, The Energy Charter Secretariat are currently working with the International Mediation Institute and various dispute resolution institutes to create an effective and clear model for investment mediation in the energy sector.
SCC Secretary General Annette Magnusson spoke in a part of the round table dedicated to investigate how to upgrade the mechanism for settlement of energy disputes in order to encourage and secure protection of energy investments.
